Cyberstalking in India: What Is the Law?

Cyberstalking generally describes persistent unwanted online conduct such as repeated contact, monitoring or harassment. Indian law can apply differently depending on the victim, conduct and circumstances.

BNS Section 78

Section 78 of the Bharatiya Nyaya Sanhita, 2023 addresses stalking. It includes repeatedly following or contacting a woman to foster personal interaction despite a clear indication of disinterest, and monitoring a woman’s use of the internet, email or another electronic communication. Statutory exceptions apply. citeturn0search12

Evidence matters

Preserve screenshots, URLs, usernames, phone numbers, emails, chat histories and dates. A pattern of conduct may be important in understanding the complaint.
