Caste Discrimination by Teacher Legal Action
Caste Discrimination by Teacher Legal Action legal assistance is intended for students facing alleged caste discrimination, caste-based harassment, exclusion, intimidation or other unlawful treatment in colleges, universities, hostels or other educational institutions in India. The appropriate remedy depends on the facts, the institution, the conduct alleged and the applicable law.
Caste discrimination in educational institutions
Caste-based discrimination can raise constitutional, statutory, institutional and, in appropriate cases, criminal-law issues. Articles 14, 15 and 17 of the Constitution form an important part of India’s equality and anti-untouchability framework. The Protection of Civil Rights Act, 1955 and the SC/ST (Prevention of Atrocities) Act, 1989 may also become relevant where their statutory requirements are satisfied.
UGC grievance and equity framework
The University Grants Commission currently lists the UGC (Redressal of Grievances of Students) Regulations, 2023 and, importantly for caste-discrimination complaints, the UGC’s 2026 Promotion of Equity in Higher Education Institutions Regulations. UGC materials also require universities/institutions to report on mechanisms for complaints of caste-based discrimination involving SC/ST/OBC students, teachers and non-teaching staff. citeturn0search0turn0search1turn0search24
What a student can document
- Written or electronic communications containing caste-related remarks or discriminatory instructions.
- Names and contact details of witnesses.
- College/university or hostel notices, emails and complaint acknowledgements.
- Academic or administrative records relevant to the allegation.
- Audio, video, screenshots or other electronic evidence, where lawfully obtained.
- A detailed chronology showing dates, locations, persons involved and what occurred.
Internal college or university complaint
A student may have access to the institution’s grievance mechanism, equity or anti-discrimination committee, student grievance redressal process or other designated authority. The appropriate institutional mechanism depends on the institution and its applicable rules. UGC maintains a student-centric regulations framework that includes the Student Grievance Redressal Regulations, 2023. citeturn0search1
When criminal or statutory action may be relevant
If the conduct potentially satisfies the ingredients of an offence under the SC/ST Act, the Protection of Civil Rights Act or another criminal statute, a police complaint or other legal remedy may be considered. Merely identifying a dispute as “caste discrimination” does not automatically establish a particular criminal offence; the exact words, acts, circumstances, identity of the parties and evidence need to be examined.
If the complaint is ignored or not resolved
Keep proof of the complaint, acknowledgement, correspondence and responses from the institution. Depending on the facts, legal advice may concern escalation within the institution, representation to the competent authority, a police complaint where a cognizable offence is alleged, or an appropriate statutory or constitutional remedy.
SC/ST student legal assistance
SPG Legal Consultancy can assist students with complaint review, evidence organisation, legal notices, institutional grievance processes and case-specific advice concerning caste discrimination, SC/ST Act matters and related legal remedies in Pune and Maharashtra.
